HostLabs will only release user account information pursuant to a valid legal process such as a search warrant, subpoena or court order. If you are seeking such identity or account information in connection with a civil legal matter you must serve HostLabs with a valid subpoena. This information can only be obtained by a properly issued subpoena served upon our Legal Department:
HostLabs: Legal Department
1908 N. Enterprise St.
Anaheim, CA 92865
In addition to serving a physical copy of all documents on our legal department, sending an electronic version of the subpoena and related documents by email to [email protected] will often result in a more timely response.
Subpoenas issued by Regulatory and Law Enforcement Agencies
In most instances, HostLabs will comply with lawfully issued U.S. and state government subpoenas to the extent that they are not unduly burdensome, overbroad or unreasonably invasive of our customer’s privacy. The subpoena should be as narrow in scope as possible and should identify the specific customer name or domain name relating to the information requested, as well as any other information which might assist us in determining the identity of the account holder. A subpoena seeking information based upon an IP address alone will be rejected since IP addresses often relate to more than one customer. For example, we will return any subpoena that contains overly broad descriptions of the information sought such as “all information related to” or “any data” as overbroad causing a delay in any response. Please contact [email protected] for assistance in framing the language of subpoena requests.
It is our practice to notify the customer of any record request. Where the subpoena or other order requires that the subject of the demand not be informed, the demand must clearly state that that it is issued pursuant to a confidential or criminal investigation with authority sufficient to support such request.
Subpoenas Issued In Civil Litigation and Other Matters
Subpoenas for customer information must be issued by or domesticated through a court having personal jurisdiction over HostLabs. HostLabs is located in Orange County, California and we accept service from all courts of the State of California the from the United States District Courts for the Central District of California. We reserve the right to reject any subpoena not from these courts or ratified thereby.
HostLabs is not authorized to release customer account information absent a valid subpoena or other such legal process in relation to an ongoing legal action reasonably involving or related to the request for information. Such requests must be reasonably tailored as to scope and time. HostLabs may request a copy of the Complaint, counterclaim cross complaint or other pleadings to make the determination of reasonableness. A subpoena seeking information based upon an IP address alone will be rejected since IP addresses often relate to more than one customer. For example, we will return any subpoena that contains overly broad descriptions of the information sought such as “all information related to” or “any data” as overbroad causing a delay in any response.
Upon receipt of a subpoena and initial review of its legal sufficiency, HostLabs will attempt to notify the member(s) whose account information is being sought. Any subpoena must allow a minimum of twenty (20) days in order to allow named members the opportunity to move to quash the subpoena.
HostLabs will determine at its sole discretion the applicability of this policy to any particular subpoena. This policy does not create any enforceable legal rights, either for HostLabs customers, or for requesting parties.
To defer the cost to HostLabs of compliance with Subpoenas and other record requests, payment of the following minimum fees are required for all Federal Document Requests, subpoenas, court orders, and search warrants. Requests dealing with imminent physical harm to any individual, particularly children may be expedited voluntarily by HostLabs and there will be no fee. In all cases, an estimate of fees will be provided prior to commencement of production. HostLabs reserves the right to require payment in advance of preparation of production materials.
